Why most state insurance data can't be resold, and what we use instead

Sources checked 18 October 2026. The same rules are on thestandards page.

A public table is not a licence to resell it. A state insurance department can post complaint counts, examination totals and penalty orders, and still limit copying to personal or noncommercial use. Global Data Insights includes a figure in Carrier Claims Evidence only when three things are true. The source terms allow the figures to be copied and redistributed. The material is from 2021 or later. A number can be parsed from the document rather than estimated. If one of those fails, the figure is left out. An empty cell means the source did not list the figure. It does not mean the count is zero unless the source printed zero.

The National Association of Insurance Commissioners complaint systems, CIS and GRID, allow personal, non-commercial use only, so they are not used. Company-level Market Conduct Annual Statement files are not used, and neither is any MCAS scorecard whose terms restrict advertising. A rate stipulation is not treated as a claims penalty.

State sites were read on 18 October 2026 and excluded when the retrieved terms did not grant commercial reuse.

Wisconsin says the material is for the noncommercial use of the general public. That excludes the insurance site, including older MCAS scorecards (Wisconsin policies). Indiana grants a limited licence "for your own personal use, and not for republication, distribution, assignment, sublicense, sale." The auto complaint-index PDFs stay out (Indiana terms). North Carolina allows copying "for non-commercial use." Examination PDFs and bulletins on nc.gov stay out (North Carolina terms). South Carolina says materials are posted with the owner's permission, and that "any unauthorized use of the information on this website is at the user's own risk." No grant to copy and redistribute was found (South Carolina disclaimer). The Kentucky insurance department home page says "© Commonwealth of Kentucky. All rights reserved." No copy grant was on the page retrieved.

Florida, New Jersey, Massachusetts, Kansas and Washington were checked the same day. No permissive reuse clause was retrieved. Florida's disclaimer URLs returned 404. New Jersey pages were redirects and did not include a reuse grant or a parseable 2021-or-later pair. The Massachusetts legal notice returned "Not allowed." Kansas returned a short "Page Moved" response, and the disclaimer page had no reuse clause. Washington's copyright URL was a 404, and no reuse grant was on the pages retrieved. A data.wa.gov dataset that turned up was not an insurer claims file.

Five states are in the file because a reuse sentence was found.

California's privacy policy says: "Information and content found on this Website, unless otherwise indicated, is considered in the public domain. It may be distributed or copied as permitted by law" (California privacy policy). Logos and seals are not used. The file uses the automobile complaint composite for 2025, 2024 and 2023, the 2024 market-share table for the insurer list and premium only, and one consent order. Order NC-2025-00013 contains the parsed sentence "pay a penalty of $500,000.00". The subject is nonrenewal notices to private-passenger customers. Rate stipulations were not used. Two other orders did not contain a sentence of that form, so no amount from those files is published.

Maryland's disclaimer says: "Information presented on this website is considered public information and may be distributed or copied" (Maryland Insurance Administration disclaimer, insurance.maryland.gov). Linking to the Administration's site needs its permission. Copying the information does not carry a commercial ban. The file copies figures and cites the URL. It does not frame the Administration's site. The sources are Appendix 3 of the 2024 annual report, private passenger, and three orders with stated penalties of $70,000, $15,000 and $1,000.

For Delaware, the department home page, the GEICO market-conduct examination and the enforcement page were read. No noncommercial clause and no "all rights reserved" clause were found. The disclaimer URL returned a page-not-found. Paid, closed-without-payment and denied populations reconcile to the report's totals: 30,248, 14,174 and 922. The claims period is 1 January 2021 through 31 December 2023. Fine amounts come from the department's enforcement data file, because the stipulation PDFs are images and were not retyped. The file uses examination files whose names are 2021 or later and that name private-passenger groups.

Texas is complaint data only, from the Texas Open Data Portal, not from tdi.texas.gov. The portal says: "Open data refers to information that can be freely used, re-used, and redistributed by anyone" (Texas Open Data Portal). A cached page of the department's own disclaimer grants permission to copy "for noncommercial use, as long as the content remains unaltered." Documents on tdi.texas.gov stay out, including the 2024 appraisal data call and the market-share pages. The published page does not sort companies by the complaint index.

New York is complaint data only, from data.ny.gov, for filing years 2021 through 2024. The dataset's licence field is empty. The portal terms are the OPEN-NY Terms of Use, last modified 8 March 2013 (OPEN-NY Terms of Use). Those terms say: "You are welcome to freely download and use this Content as long as you abide by these Terms of Use." They also say: "So long as you are not doing anything malicious with NYS data, you may use it as you wish, subject to no other requirements." They say the information may be used in private sector projects. A separate section limits comments uploaded to a forum, including "the promotion of commercial ventures." That section is about posting, not about downloading. The Rank column is not copied. No second New York source was found.

California, Maryland and Delaware each have two usable source types. Texas and New York have complaint data only. Where a permissive market-share table exists, it is used for the insurer list and is not counted as a second claims source. Restricted sources were not added to make the file longer.

Carrier Claims Evidenceis those regulator-published complaint, examination and penalty figures for the five states. Asample CSV, California, 12 groups, is on the product site. The file is refreshed when regulators publish. It does not add a grade, a score or a rank.
